The man who died in Friday's deadly use of force incident in Pine County has been identified as Anthony Michael Legato, 25, of Oak Park Heights, Minnesota, by the Midwest Medical Examiner's Office. According to the preliminary autopsy, Legato died of a gunshot wound.
The Bureau of Criminal Apprehension has also identified Deputy Joshua Pepin with the Pine County Sheriff's Office, as the deputy who shot Legato during the incident. He has been with the sheriff's office for five years and has been placed on standard administrative leave.
According to the BCA report, while fleeing law enforcement, Legato entered Interstate 35 near Mora, driving south in the northbound lane. Shortly after, he pulled to the side of the highway and left his vehicle.
Pepin was driving northbound on I-35 and pulled over immediately south of Legato’s vehicle. As Pepin exited his squad, Legato then reentered his vehicle and began to pull out into oncoming traffic. At one point the deputy fired his weapon.
Portions of the incident were captured on body and squad cameras.
The BCA investigation is ongoing and when complete the findings will be provided to the Pine County Attorney's Office for review.
