A Cloquet man charged with criminal vehicular homicide in connection with a July 29 traffic accident that killed a 34-year-old Esko man made his first court appearance in Duluth last Friday.

Sixth Judicial District Judge Shaun Floerke released Jerry J. Jubie, 38, on his own recognizance with the condition that he not use alcohol or controlled substances. Jubie's next scheduled court appearance is set for Nov. 24.

Jubie is charged with two counts of criminal vehicular homicide, two counts of criminal vehicular operation and two counts of driving while impaired.

According to the criminal complaint:

The accident occurred on Guss Road in Midway Township near the Buffalo House restaurant about 11:40 p.m.

Christopher Hammer was a passenger in the vehicle Jubie was driving. He was ejected when the vehicle left the road. He died at the scene. Another passenger, Scott Sertich, 39, was injured in the accident.

Tests indicated that Jubie had a blood-alcohol concentration of .15, nearly double the legal limit to drive.
