WATER INFRASTRUCTURE
IMPROVEMENT PROJECT
Notice is hereby given that the Town Board of Twin Lakes Township will meet at 6:00 p.m. on Thursday, July 15, 2021 at the Carlton County Transportation Building, 1630 County Road 61, Carlton, Minnesota 55718, for a meeting and will hold a public hearing to consider, and possibly adopt, the proposed assessment roll for the Twin Lakes Township Water Infrastructure Improvement Project, which includes the installation of a water distribution system to serve portions of Twin Lakes Township. The properties proposed to be specially assessed for the improvements include properties to which the new water distribution system will be made available for connection. Adoption by the Town Board of the proposed assessment against the properties benefited may occur at the meeting.
The total cost of the above-referenced project is approximately $8,236,496.00, of which $774,855.00 is proposed to be specially assessed to benefiting properties. The proposed assessment roll is on file for public inspection at the office of the Town Clerk and will be made available at the hearing. Such assessment is proposed to be payable in equal annual installments extending over a period of 20 years, the first of the installments to be payable on or before the first Monday in January 2022, and will bear interest at the rate of no greater than four percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2022. To each subsequent installment when due shall be added interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the entire assessment on such property to the Town Clerk. No interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. An owner may at any time thereafter, pay the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 of any year or interest will be charged through December 31 of the succeeding year. If an owner decides not to prepay the assessment within 30 days from the adoption of this assessment, the rate of interest that will apply is the rate determined in the assessment resolution, which shall not exceed four percent per annum. The right to partially prepay the assessment is not available.
Written or oral objections will be considered at the hearing. No appeal to district court may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the Town Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Town Board may at the hearing or at any adjournment thereof upon such further notice as it deems advisable to the affected property owners consider any objection to the amount of a proposed individual assessment.
An owner may appeal an assessment to district court pursuant to Minn. Stat. § 429.081 by serving notice of the appeal upon the Town Chair or the Town Clerk within 30 days after the adoption of the assessment and filing such notice with the district court within 10 days after service upon the Town Chair or the Town Clerk.
