ORDINANCE NO. 2019-02

AN ORDINANCE ABOLISHING THE PLANNING COMMISSION AND RETURNING ALL AUTHORITY TO THE CITY COUNCIL

BE IT ORDAINED, that with an unanimous vote of the Mayor and Council of the City of Wrenshall ( 9 / 25 / 19 ) the existing Planning Commission is hereby abolished and that Chapter 31 of the Wrenshall City Code, and specifically, Sections 31.45 to 31.48 shall be replaced and repealed to read as follows:

PLANNING COMMISSION

31.45 ESTABLISHMENT OF THE PLANNING COMMISSION.
Unless subsequently changed, the Mayor and City Council of the City of Wrenshall will be the city planning agency authorized by Minn. Stat. 462.354(1) as it may be amended from time to time.

31.46. COMPOSITION.
The Planning Commission shall consist of five (5) members, those being the Mayor and the four (4) City Council members. Each of the five members will have equal voting privileges and all action approved must be passed by a majority of a legally established quorum of the City Council.

31.47 ORGANIZATION, MEETINGS, AND EXPENDITURES.
The Planning Commission will meet at such times as needed but at least once per quarter. The minutes of all meetings will be kept by the City Clerk/Treasurer.

31.48 POWERS AND DUTIES; COMPREHENSIVE PLAN.
The Mayor and City Council sitting as the city planning agency will have all the powers and duties given to city planning agencies by law including, but not limited to, all powers set forth in Minn. Stat. Sections 462.351 to 462.398 inclusive. Those powers will be necessarily include the authority to conduct public hearings regarding zoning and development issues and to develop, review, implement and monitor a comprehensive plan for the physical development of the city.

(A) Appeals. All decisions made by the Mayor and City Council sitting as the city planning agency are considered final. Any and all appeals contesting the validity of action taken must be taken directly to the District Court for the County of Carlton for final judicial review.

This Ordinance shall take effect upon its passage and publication
