RESOLUTION NO. 15-03

RESOLUTION ORDERING THE REPAIR OR REMOVAL OF HAZARDOUS CONDITIONS LOCATED AT 34 HIMANGO ROAD, ESKO, MINNESOTA 55733

WHEREAS, pursuant to Minn. Stat. §§ 463.15 and 463.261, the Board of Supervisors of the Town finds the building with the legal description of Lot 12, Block 1, Southridge, and known by the address 34 Himango Street to be a hazardous building for the following reasons:

1. The home is unsecure and open to the public.
2. The home has been left unheated, which caused the water pipes to freeze and crack.
3. The concrete block foundation walls are cracking due to frozen ground pushing in from the outside.
4. The home is also disconnected from the electrical company.
5. There is mold growth throughout the home and a musty odor is present.
6. The yard and storage shed area are cluttered with garbage and debris.

WHEREAS, the conditions listed above are more fully documented in the inspection report and photographs prepared by Gerry Manthey on April 7, 2015, copies of which are attached to this resolution as Exhibit A.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE TOWN OF THOMSON, MINNESOTA, AS FOLLOWS:

1. That pursuant to the foregoing findings and in accordance with Minn. Stat. §§ 463.15 and 463.261, the Board orders the record owners of the above hazardous building or their representatives to make the following corrections on the property at 34 Himango Road:

a. The cracks in the foundation need to be repaired so that the foundation is structurally sound.
b. The home needs to be secured so that the general public cannot enter the home.
c. The debris in the yard and storage shed need to be cleaned up to prevent rodent infestation.
d. The mold within the home needs to be abated.
e. The pipes damaged by freezing need to be repaired.

2. That the repairs listed above must all be made within one hundred twenty (120) days after the order is served upon the property owner. The repairs must be completed in compliance with all applicable codes and regulations and done pursuant to proper permits from the Town.

3. That a motion for summary enforcement of the order will be made to the District Court of Carlton County in which the hazardous building is situated unless corrective action is taken or an answer is filed within the time specified in Minn. Stat. § 463.18, which is twenty (20) days.

4. That in accordance with Minn. Stat. § 463.24, the owner or occupant must remove all personal property and/or fixtures that will reasonably interfere with the work within one hundred twenty (120) days. If the property and/or fixtures are not removed and the Town enforces this order, the Town may sell personal property, fixtures, and/or salvage materials at a public auction after three days posted notice.

5. That if the Town must take actions to enforce this order, all enforcement costs will be specially assessed against the property and collected in accordance with Minn. Stat. §§ 463.22, 463.21, and 463.161.

6. That the city attorney is authorized to serve this order upon the owner of the premises at 34 Himango Road and all lien-holders of record.

7. That the city attorney is authorized to proceed with the enforcement of this order as provided in Minn. Stat. §§ 463.15 and 463.261.
