NOTICE OF FINAL AGENCY DETERMINATION TO TAKE LAND "IN TRUST"

SUMMARY: The Superintendent, Minnesota Agency, Bureau of Indian Affairs, U.S. Department of the Interior, on the below date, made a final agency determination to acquire 654 acres, more or less, of land "in trust" for the Fond du Lac Band of the Minnesota Chippewa Tribe.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR 151.12(b) that notice be given to the public of the decision by the authorized representative of the Secretary of the Interior to acquire land "in trust" at least 30 days prior to signatory acceptance of land "in trust". The purpose of the 30-day waiting period in 25 CFR 151.12(b) is to afford interested parties the opportunity to seek judicial review of administrative decisions to take land "in trust" for tribes or individual Indians before transfer of title to the property occurs. On November 20, 2018, the Superintendent, Minnesota Agency, decided to accept 541 acres, more or less, of land "in trust" for the Fond du Lac Band of the Minnesota Chippewa Tribe, pursuant to the Indian Reorganization Act (IRA) of June 18, 1934 (48 Stat. 984; 25 U.S.C. 465).

The Superintendent, Minnesota Agency, on behalf of the Secretary of the Interior, shall acquire title in the name of the United States of America "in trust" for the Fond du Lac Band of the Minnesota Chippewa Tribe to the following parcels of land no sooner than 30 days after the date this notice is published in newspapers of general circulation within the State of Minnesota, County of St. Louis..

The land referred to herein is situated in the State of Minnesota, St. Louis County, being more particularly described as follows:

Parcel 1: Northwest Quarter of the Northwest Quarter (NW¼ NW¼); Section 20, Township 50N, Range 17W of the 4th Principal Meridian, St. Louis County, Minnesota, containing 40.00 acres more or less.

Parcel 2: The North Half of the Southwest Quarter of the Northwest Quarter (N½SW¼NW¼); Section 20, Township 50N, Range 17W of the 4th Principal Meridian, St. Louis County, Minnesota, containing 20.00 acres more or less.

Parcel 3: The West Half of the East Half of the Southwest Quarter (W½ E½ SW¼), Section 21, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota. Except the South 1979.84 feet thereof, together with and subject to a 66.00 feet wide easement for driveway purposes lying over, under and across the East Half of the Southwest Quarter (E½ SW¼) of Section 21, Township 50N, Range 17W of the 4th Principal Meridian, St. Louis County, Minnesota, the centerline of said easement is described as follows:

Commencing at the southwest comer of the East Half of the East Half of the Southwest Quarter (E½ E½ SW¼) of said Section 21; thence on an assumed bearing of North 89 degrees 42 minutes 13 seconds West, along the south line of said Section 21, a distance of 80.89 feet, to the point of beginning of said centerline; thence North 00 degrees 17 minutes 47 seconds East, a distance of 59.03 feet; thence North 36 degrees 30 minutes 21 seconds East, a distance of 134.51 feet, to the west line of said East Half of the East Half (E½ E½); thence North 00 degrees 11 minutes 32 seconds West, along said west line a distance of 1878.35 feet and there terminating. Containing 10.00 acres more or less.

Parcel 4: The north 659.32 feet of the south 1979.84 feet of the East Half of the East Half of the Southwest Quarter (E½ E½ SW¼) of Section 21, Township 50 North, Range 17 West of the 4th Principal Meridian, St. Louis County, Minnesota. Together with and subject to: A 66.00 foot wide easement for driveway purposes lying over, under and across the East Half of the Southwest Quarter (E½ SW¼) of Section 21, Township 50 North, Range 17 West of the 4th Principal Meridian, St. Louis County, Minnesota, the centerline of said easement is described as follows:

Commencing at the southwest corner of the East Half of the East Half of the Southwest Quarter (E½ E½ SW¼) of said Section 21; thence on an assumed bearing of North 89 degrees 42 minutes 13 seconds West, along the south line of said Section 21, a distance of 80.89 feet, to the point of beginning of said centerline; thence North 00 degrees 17 minutes 47 seconds East, a distance of 59.03 feet; thence North 36 degrees 30 minutes 21 seconds East, a distance of 134.51 feet, to the west line of said East Half of the East Half (E½ E½); thence North 00 degrees 11 minutes 32 seconds West, along said west line a distance of 1878.35 feet and there terminating. And together with and subject to: A 50.00 foot wide easement for driveway purposes lying over, under and across the south 50.00 feet of the north 659.32 feet of the south 1979.84 feet of the East Half of the East Half of the Southwest Quarter (E½ E½ SW¼), of Section 21, Township 50 North, Range 17 West of the Fourth Principal Meridian, St. Louis County, Minnesota, containing 10.00 acres, more or less.

Parcel 5: The Southeast Quarter of the Northeast Quarter (SE¼ NE¼), of Section 21, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 40.23 acres more or less.

Parcel 6: The Southeast Quarter of the Northeast Quarter (SE¼ NE¼), of Section 27, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 41.73 acres more or less.

Parcel 7: The West Half of the Southwest Quarter (W½ SW¼), of Section 27, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 79.78 acres more or less.

Parcel 8: The West Half of the Southwest Quarter (W½ SW¼), Section 28, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota,

EXCEPT the following:

1) The North 2000 feet of the West Half of the Southwest Quarter, Section 28, Township 50N, Range 17W, EXCEPT The East 387 feet.

2) The Northerly 2251.18 feet of the East 387 feet of said West Half of the Southwest Quarter, Section 28, Township 50N, Range17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 16.96 acres more or less.

Parcel 9: Government Lot 3, Section 30, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 39.77 acres more or less.

Parcel 10: The Southeast Quarter of the Southeast Quarter (SE¼ SE¼), of Section 30, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 39.40 acres more or less.

Parcel 11: The Southwest Quarter of the Northeast Quarter (SW¼ NE¼), Section 30, Township 50N, Range 17W, 4th Principal Meridian, St. Louis County, Minnesota, containing 39.40 acres more or less.
