NOTICE OF MORTGAGE FORECLOSURE SALE
Date: March 8, 2013
YOU ARE NOTIFIED THAT:
1. Default has occurred in the conditions of that certain Real Estate Mortgage dated November 12, 2010 executed by Patrick R. Crouley and Dana S. Crouley, husband and wife, as mortgagor, to Frandsen Bank & Trust, a Minnesota chartered banking corporation, successor by merger to Queen City Federal Savings Bank, as lender, filed for record November 18, 2010 as Document Number A000434273 in the Office of the County Recorder of Carlton County, Minnesota. The land described in the Mortgage is not registered land.
2. The Mortgage has not been assigned.
3. The original principal amount secured by the Mortgage was $155,000.00.
4. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
5. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.
6. At the date of this notice the amount due on the Mortgage, and taxes, paid by the holder of the Mortgage is $152,516.24.
7. Pursuant to the power of sale in the Mortgage, the Mortgage will be foreclosed, and the land described as follows:
That part of the Southeast Quarter of the Northeast Quarter (SE ¼ of NE ¼), Section Twenty-nine (29), Township Forty-eight (48), Range Sixteen (16), Carlton County, Minnesota, described as follows:
Commencing at a point on the South line of said quarter section 33 ft. West of the Southeast Quarter corner; thence proceeding in a Northerly direction parallel with the East line of said quarter section, a distance of 849.36 ft.; thence in a Westerly direction parallel with the South line of said quarter section, a distance of 46.34 ft. to a place of beginning; thence continuing Westerly parallel with the South line of said quarter section for a distance of 70.66 ft.; thence in a Southerly direction parallel with the East line of said quarter section, a distance of 85 ft.; thence in a Westerly direction parallel with the South line of said quarter section, a distance of 60 ft.; thence in a Northerly direction on a line parallel with the East line of said quarter section, a distance of 96.5 ft.; thence in an Easterly direction along a line parallel with the South line of said quarter section, a distance of 130.66 ft.; thence in a Southerly direction along a line parallel to the East line of said quarter section, a distance of 11.5 ft. to the Point of Beginning.

That part of the Southeast Quarter of the Northeast Quarter (SE ¼ of NE ¼), Section Twenty-nine (29), Township Forty-eight (48), Range Sixteen (16), Carlton County, Minnesota, described as follows:
Commencing at a point on the South line of said Southeast Quarter of the Northeast Quarter of said Section 29, 33 ft. West of the Southeast Quarter corner; thence proceeding in a Northerly direction parallel with the East line of said quarter section, a distance of 849.36 ft. to a place of beginning; thence in a Westerly direction parallel with the South line of said quarter section, a distance of 117 ft.; thence in a Southerly direction parallel with the East line of said quarter section, a distance of 87 ft.; thence in an Easterly direction parallel with the South line of said quarter section, a distance of 117 ft.; thence in a Northerly direction parallel with the East line of said quarter section, a distance of 87 ft., more or less, to the place of beginning.
TOGETHER WITH all rights, easements, appurtenance, royalties, mineral rights, oil and gas rights, crops, timber, all diversion payments or third party payments made to crop producers, and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be part of the real estate described herein, any and all water wells, water, ditches, reservoirs, reservoir sites and dams located on the real estate and all riparian and water rights associated with the real property, however established, all rights to payment, whether or not earned by performance, including, but not limited to, payment for property or services sold, leased, rented, licensed, or assigned, any rights and interests (including all liens) against any account debtor or obligor, all inventory held for ultimate sale or lease, or which has been or will be supplied under contracts or service, or which are raw materials, work in process, or materials used or consumed in business, all equipment including, but not limited to, machinery, vehicles, furniture, fixtures, manufacturing equipment, farm machinery and equipment, shop equipment, office and record keeping equipment, parts and tools, all general intangibles including, but not limited to, tax refunds, patents and applications for patents, copyrights, trademarks, trade secrets, goodwill, trade names, customer lists, permits and franchises, payment intangibles, computer programs and all supporting information provided in connection with a transaction relating to computer programs,
will be sold by the Sheriff of Carlton County, Minnesota, at public auction on Tuesday, May 7, 2013 at 10:00 a.m., at the Carlton County Sheriff's Office, 317 Walnut Avenue, Carlton, Minnesota 55718.
8. The time allowed by law for redemption by Mortgagor or Mortgagor's personal representatives or assigns is six (6) months after the date of sale.
9. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR'S PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
10. THIS COMMUNICATION IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
11. RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
