Duluth judge to hear the case of woman charged with vehicular homicide

The case of Vanessa Rae Brigan, 26, of Cloquet is at a temporary standstill in Carlton County Court. Brigan is facing two felony charges of criminal vehicular homicide while under the influence of a controlled substance in connection with a crash that killed two Carlton County Highway Department workers near Wright on Oct. 1, 2012, on her way back from a methadone clinic in Brainerd.
Brigan’s scheduled hearing on Thursday, Jan. 10, was postponed, and on Wednesday County Attorney Thom Pertler explained the reason why. Pertler said both Judge Dale Wolf and Judge Robert Macaulay have recused themselves from the case because the father of one of the accident victims is an attorney in Carlton County.
Pertler said Judge Dale Harris of Duluth has agreed to hear the case in Carlton County, and an assignment clerk has been charged with coming up with a list of available dates for potential hearings.
Brigan waived her right to a speedy omnibus on Oct. 15, 2012.
Brigan also faces a misdemeanor charge of driving with no proof of insurance. Frank Yetka, attorney for the city of Cloquet, indicated that Brigan has been in custody long enough to resolve that issue but agreed to wait until her other charge has been dealt with before any further action is taken. She remains in custody in the Carlton County Jail.
