NOTICE OF FINAL AGENCY DETERMINATION TO TAKE LAND "IN TRUST"
SUMMARY: The Superintendent, Minnesota Agency, Bureau of Indian Affairs, U.S. Department of the Interior, on the below date, made a final agency determination to acquire 172.05 acres, more or less, of land "in trust" for the Fond du Lac Band of Chippewa Indians of the Minnesota Chippewa Tribe.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR 151.12(b) that notice be given to the public of the decision by the authorized representative of the Secretary of the Interior to acquire land "in trust" at least 30 days prior to signatory acceptance of land "in trust". The purpose of the 30-day waiting period in 25 CFR 151.12(b) is to afford interested parties the opportunity to seek judicial review of administrative decisions to take land "in trust" for tribes or individual Indians before transfer of title to the property occurs. On August 8, 2012, the Superintendent, Minnesota Agency, decided to accept 172.05 acres, more or less, of land "in trust" for the Fond du Lac Band of Chippewa Indians of the Minnesota Chippewa Tribe, pursuant to the Indian Reorganization Act (IRA) of June 18, 1934 (48 Stat. 984; 25 U.S.C. 465).
The Superintendent, Minnesota Agency, on behalf of the Secretary of the Interior, shall acquire title in the name of the United States of America "in trust" for the Fond du Lac Band of Chippewa Indians of the Minnesota Chippewa Tribe to the following parcels of land no sooner than 30 days after the date this notice is published in newspapers of general circulation within the State of Minnesota, County of St. Louis.
The land referred to herein is situated in the State of Minnesota, St. Louis County, being more particularly described as follows:
Garlinghouse Parcel:
Parcel 1: The Southwest Quarter of the Southeast Quarter of the Southeast Quarter (SW1/4 SE1/4 SE1/4) of Section Thirty-three (33), Township Fifty (50), North of Range Eighteen (18), West of the Fourth Principal Meridian, containing 10.00 acres more or less.
Parcel 2: The Northwest Quarter of the Southeast Quarter of the Southeast Quarter (NW1/4 SE1/4 SE1/4) of Section Thirty-three (33), Township Fifty (50), North of Range Eighteen (18), West of the Fourth Principal Meridian, containing 10.00 acres more or less.
Parcel 3: The Northeast Quarter of the Northwest Quarter (NE1/4 NW1/4) of Section Seventeen (17), Township Fifty (50), North of Range Eighteen (18), West of the Fourth Principal Meridian, containing 40.00 acres more or less.
Parcel 4: Government Lot Four (4) of Section Fifteen (15), Township Fifty (50), North of Range Seventeen (17), West of the Fourth Principal Meridian, containing 35.25 acres more or less.
Parcel 5: Government Lot One (1) of Section Twenty-seven (27), Township Fifty (50), North of Range Seventeen (17), West of the Fourth Principal Meridian, containing 36.75 acres more or less.
Parcel 6: Government Lot Four (4), also described as the fractional Southwest Quarter of the Southwest Quarter (SW1/4 SW1/4) of Section Thirty (30), Township Fifty (50), North of Range Seventeen (17), West of the Fourth Principal Meridian, containing 40.05 acres more or less.
