A Hibbing man has been sentenced to 51 months in prison for the first-degree burglary in January of a Thomson Township house where the homeowner confronted him and held him until police came.
William Peter Lushenko, 44, pleaded guilty and was sentenced Tuesday in State District Court in Carlton County by Judge Dale Wolf. Charges of third-degree assault, interference with an emergency call and receiving stolen property were dismissed as part of a plea agreement. Lushenko had originally pleaded not guilty to all charges but later amended his plea to guilty on the burglary charge.
Judge Wolf ordered that Lushenko immediately report to the commissioner of corrections. He will be given credit for 98 days in jail already served. Lushenko also must pay $210 in court fees and $1,759.23 in restitution.
According to the criminal complaint, Carlton County dispatch received a call of a burglary in progress in the 200 block of Canosia Road about 12:10 p.m. on Jan. 24.
Officers arrived and found the homeowner struggling with an intruder, later identified as Lushenko.
The homeowner told officers he was in the basement of his home when he heard a faint knock on his front door. A short time later he walked upstairs and found Lushenko in a bedroom.
As the homeowner called 911, Lushenko began punching him, but the homeowner was able to hold Lushenko down until officers arrived, the complaint said. After the incident, the homeowner reported that he had probably broken his hand in the altercation with Lushenko.
At that point, Lushenko admitted entering the home and also admitted to having stolen license plates on his truck, which was found outside the home in the driveway, the complaint said. Officers also found a box of coins in Lushenko’s truck that had been reported stolen from a home in Hibbing.
