NOTICE OF MORTGAGE FORECLOSURE
NOTICE IS HEREBY GIVEN that default has occurred in the conditions of that certain Mortgage, dated February 23, 2006, executed by Mathew Fietek and Stephanie Fietek, a married couple, as Mortgagor, to Minnesota Power Employees Credit Union, a banking corporation, as Mortgagee, and filed for record in the Office of the County Recorder in and for the County of Carlton and State of Minnesota on March 8, 2006, as Document No. A000399967. The land described in the Mortgage is not registered. The original principal amount secured by the Mortgage was $46,000.00. No action or proceeding has been instituted at law to recover the debt secured by the Mortgage, or any part thereof. All conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage as required by the Mortgage or applicable law, including the giving of Notices to the Mortgagors, have been complied with by the Mortgagee; that there is due and claimed to be due upon said Mortgage, including interest to date hereof, the sum of $41,855.62, and that pursuant to the power of sale therein contained, said Mortgage will be foreclosed and the tract(s) of land lying and being in the County of Carlton, State of Minnesota, described as follows, to-wit:
Lot Four (4), Block Three (3), Otter Creek, subject to easements, covenants, restrictions and mineral reservations of record, if any
will be sold by the Sheriff of said County at public auction on November 29, 2011, at 10:00 a.m. at the main office of the Carlton County Sheriff, 317 Walnut Avenue, Carlton, Minnesota, to pay the debt then secured by said mortgage and taxes, if any, paid by the mortgagee, on the premises and the costs and disbursements allowed by law. The time allowed by law for redemption by the mortgagor(s), their personal representative or assigns is six (6) months from the date of said sale.
The date that occupants would be required to move is at 11:59 p.m. on May 29, 2012, unless the mortgage is reinstated or redeemed in accordance with the law.
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGORS, THE MORTGAGORS PERSONAL REPRESENTATIVE OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITES, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
