NOTICE OF BIA SUPERINTENDENT'S DECISION TO ACQUIRE LAND "IN TRUST"
ACTION: Notice of Decision to acquire land into trust under 25 Code of Federal Regulations, Part 151.
SUMMARY: The Superintendent, Minnesota Agency, Bureau of Indian Affairs, U.S. Department of the Interior, on the below date, has made a determination to acquire 433.90 acres, more or less, of land "in trust" for the Fond du Lac Band of the Minnesota Chippewa Tribe. The land referred to as former Enbridge property, herein and is described as:
Parcel 1: Government Lot 12, SW¼SE¼, Section 6, Township 49N, Range 18W, 4th Principal Meridian, Carlton County, Minnesota, containing 83.64 acres more or less.
Parcel 2: NE¼NW¼, W½NW¼, Section 16, Township 49N, Range 18W, 4th Principal Meridian, Carlton County, Minnesota, containing 119.09 acres more or less.
Parcel 3: NE¼NE¼, NW¼NE¼, Section 17, Township 49N, Range 18W, 4th Principal Meridian, Carlton County, Minnesota, containing 78.95 acres more or less.
Parcel 4: NE¼NW¼, Section 21, Township 49N, Range 18W, 4th Principal Meridian, Carlton County, Minnesota, containing 40.18 acres more or less.
Parcel 5: NE¼NE¼, NW¼NE¼, SE¼NE¼, Section 27, Township 49N, Range 18W, 4th Principal Meridian, Carlton County, Minnesota, containing 112.04 acres more or less.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR 151.12(d)(2)(iii) that notice be given of the decision by the authorized representative of the Secretary of the Interior to acquire land in trust.
A copy of the determination is available from the office identified in the FOR FURTHER INFORMATION section of this notice. Any party who wishes to seek judicial review of this decision must first exhaust administrative remedies. This decision may be appealed to the Midwest Regional Director in accordance with the regulations in 25 CFR §2 (copy enclosed). Your notice of appeal must be filed in the Superintendent's office at 522 Minnesota Ave. NW, Bemidji, MN 56601 within 30 days of the date of publication of this notice. The date of filing your notice of appeal is the date it is postmarked or the date it is personally delivered to the Superintendent's office. Your notice of appeal must include your name, address, and telephone number and it should clearly identify the decision being appealed. If possible, attach a copy of the decision. The notice and the envelope in which it is mailed should be clearly labeled "Notice of Appeal." Your notice of appeal must list the names and addresses of the interested parties known to you and certify that you have sent them copies of the notice. You must also send a copy of your notice of appeal to the Regional Director, at Bureau of Indian Affairs, Midwest Regional Office, Norman Pointe II, 5600 West American Boulevard, Suite 500, Bloomington, MN 55437.
You may include a statement of reasons with your notice of appeal, explaining why you believe the decision being appealed is in error. If you do not include your statement of reasons with your notice of appeal, you must mail or deliver it to the Superintendent's office within 30 days after you file your notice of appeal. The statement of reasons and the envelope in which it is mailed should be clearly labeled "Statement of Reasons." It must be accompanied by or otherwise incorporate all supporting documents. You must send copies of your statement of reasons to all interested parties and the Regional Director.
If no appeal is timely filed, this decision will become final for the Department of Interior at the expiration of the appeal period. No extension of time may be granted for filing a notice of appeal.
