Moose Lake man charged with burglary, assault
A Moose Lake man faces charges after breaking in to a residential home and throwing a punch at one of the residents, breaking his jaw.
Brian Keith Blake, 23, appeared before Judge Robert Macaulay last Wednesday and was charged with first-degree burglary and third-degree assault.
Judge Macaulay granted Blake’s request for a public defender, ordered that he have no contact with his victim and released him on his own recognizance until his next hearing at 9 a.m. July 9.
According to the criminal complaint filed in the incident, Moose Lake police officers were called in on Feb. 27 to investigate an incident that had occurred in October 2013. The victim told police that he had received a broken jaw in an assault by Blake and has since amassed over $30,000 in medical bills, causing him to decide to file charges against Blake at this time.
Upon further investigation, Moose Lake police officers learned that sometime around Oct. 11, the victim was at a friend’s house, with another person present as well. At about 3 a.m. that day, Blake allegedly barged into the house uninvited and punched the victim once in the jaw, breaking it. The injury forced the victim to subsequently undergo jaw surgery to repair his broken jaw.
Officers spoke with the victim and both witnesses and corroborated the fact that Blake had not been invited or allowed into the apartment that evening but that he entered anyway and assaulted the victim. Committing an assault inside of an occupied home while burglarizing the home constitutes first-degree burglary, according to Assistant Carlton County Attorney Mike Boese.
