City of Duluth files another lawsuit against Band
The city of Duluth filed suit in federal court last week regarding the Fond-du-Luth Casino, alleging that the Fond du Lac Band of Lake Superior Chippewa violated a prior agreement that any enlargement of the parcel of sovereign land it oversees in downtown Duluth would require the consent and support of city government.
The suit stems from the band’s efforts to place the Carter Hotel property, 29 N. Second Ave E., in trust and to have it declared “Indian country,” exempt from local property taxes and zoning jurisdiction.
The city originally sought to have its claim against Fond du Lac in state court, but in March the Minnesota Supreme Court ruled that a federal venue would be required to hear the case.
A copy of the complaint was mailed to the band on Wednesday, and its attorneys will have 21 days to respond upon its receipt.
