CITY OF CLOQUET ORDINANCE NO. 432A
AN ORDINANCE TO AMEND CHAPTER 11 OF THE MUNICIPAL CODE PERTAINING TO USER CHARGES AND ESTABLISH THE CITY FEES AND CHARGES FOR 2014
The City Council of the City of Cloquet hereby ordains as follows:
Section 1. That Section 11.2.01, Subd. 10, Delinquent Accounts, first paragraph be amended by omitting "of Forty Dollars ($40.00), or an amount" in the last sentence.
Subd. 10. Delinquent Accounts. All charges for water and sewer service shall be due on the monthly due date specified by the City for the respective amount and shall be delinquent twenty (20) days thereafter. The City shall endeavor to collect delinquent accounts promptly. When the delinquent customer shall be the tenant in possession or the property owner, and satisfactory arrangements for payment have not been made, after the procedural requirements of Section 11.2.01, Subd. 12 have been complied with, the City may discontinue service to the delinquent customer by shutting off the water at the curb box. When water service to any premises has been discontinued, service shall not be restored except upon the payment of all delinquent bills and an off/on fee of Forty Dollars ($40.00), or an amount as established and adopted by resolution of the City Council from time to time.
A. Policy and Purpose. By enactment of this Ordinance, the City Council intends to establish fees and charges required by the City Code for the year 2014 and to comply with Minnesota Statutes, §462.353, Subd. 4; §340A; and other various statutory references to fees.
B. Fees and Charges. The fees and charges for the City for the year 2014 are as set forth on "Exhibit A" hereto.
C. Application. Where a direct conflict exists between the amount of a fee or charge set by any provision of the City Code and a fee or charge set by this Ordinance, the fee or charge set by the Ordinance applies.
Section 3. Effective Date. This Ordinance shall be effective immediately upon its passage and publication according to law.
